Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who engage with, access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

The Service and its original content, features and functionality are and will remain the exclusive property of Barbelle Health and its licensors.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Barbelle Health.

Barbelle Health has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Barbelle Health shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

3. Termination of Access

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation to breach of the Terms. 

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. 

4. Agreement To Pay Recurring Fees:

By purchasing a Barbelle Health membership: 

i.      I agree to pay Barbelle Health a recurring fee as per my chosen package particulars and via member authorized automatic credit or debit card. 

ii.      I accept that payment will be taken on a weekly basis unless otherwise stated by my chosen package. 

 iii.      I accept that my payment to the Service reflects a reoccurring reservation of limited class spaces at Barbelle Health as such, payments are non-refundable.  

iv.      I accept that it is my responsibility to notify the Service of any Pause or Cancellation requests giving adequate and proper notice as per Clauses 5, 6 & 7 below. 

v.      I hereby certify that I am the named holder of the debit / credit card. 

vi.      I understand that I will be notified if my credit /debit card payment fails to authorize for any reason, and that Barbelle Health reserves the right to charge a late fee if I do not provide a valid credit / debit card within 10 calendar days of the original rejection date. 

vii.      I understand that my service will be deactivated if my account falls into arrears for more than 30 calendar days. 

viii.      Payment by any means other than the member’s credit or debit card is not permitted. We do not accept any cash / card / cheque etc payments on the premises. 

 

5. Pausing / Holding of Membership:

i.           Requesting a Membership Pause:  All requests must be emailed to hello@barbellehealth.ie  giving  7 days’ notice of the affected dates. Members may only request one pause per 90 days of 14 consecutive days.We endeavour to accept all reasonable Pause requests which fall within this Policy however this may not always be possible. 

 ii.          Changes to Billing Cycle: Upon granting of a Membership Pause, the next bill will be pro-rated downwards to reflect the paused time. All bills continue to be processed on the normal billing cycle; being 1st of each month in most cases. 

 iii.      Extenuating Circumstances: Should a member require an extension of the agreed paused period due to extenuating circumstances, please email  hello@barbellehealth.ie explaining the situation. Otherwise, billing will automatically resume as per Clause (5. ii). 

 iv.      Resuming Auto-Renewal Payments: It is the responsibility of each member to communicate requests for Pausing or Pause Extensions to Us via email with 7 days’ notice of affected dates. Refunds will not be issued once payments have been processed. 

v.          Pause Extensions past 30 days: Pausing requests may not be granted beyond a maximum 30 calendar days. In these instances, the member will need to cancel his/her membership giving 10 Days Notice and re-join at a more suitable time. 

6. Missed Sessions & Appointments

Members will receive a specified amount of class credits depending on their chosen package. These credits will enable members to book their preferred class(es) within the Service’s app / website up to 30 days before the class is scheduled. Failure to show up for a reservation will result in lost credits. All members must abide by the Service’s Cancellation Policy below.  We ask all members to be ready in the gym at least 5 minutes before the session is due to begin.  Appointments:  Should you need to reschedule an appointment, please email hello@barbellehealth.ie. It may also be possible to reschedule on our website depending on your timing. Any appointment missed without 60minutes prior notice will not be rescheduled.

7. Cancelling Sessions & Class Credits:

Members will receive a specified amount of class credits depending on their chosen package. These credits will enable members to book their preferred class(es) within the Service’s app / website up to 30 days before the class is scheduled. Failure to show up for a reservation will result in lost credits. All members must abide by the Service’s Cancellation Policy.  

In signing up to Barbelle Health services, the member agrees to cancel their place in the booking system should they be unable for whatever reason to attend.  Timely cancellation is essential to Us given most classes are capped at 7 members per session and to ensure other members are given as much notice as possible to avail of the free place. You many also advertise this free class space in our Private Members Facebook Group. 

Cancellation is required:  

i.          11 Hours prior to the start of an Early Riser Class 

ii.          2 Hours prior to the start of a Mid-Morning, Lunchtime Class or Evening Class

8. Cancellation of Membership:

i.          Should you decide to terminate your membership at Barbelle Health, we require 10 Days Notice from you before the next billing cycle begins. Please send this request to hello@barbellehealth.ie   

ii.          We do not offer refunds on any prepaid memberships but will allow the member to make full use of their class credits up until the last day of the month in question. 

iii.          We may ask our members to provide feedback via an Exit Survey. We value constructive criticism and will endeavour to take all suggestions on board. This survey may also be used to provide our business with a testimonial which may be later shared on our website / social channels / Google Reviews. Reviews will be kept anonymous at the request of the participant. 

 

9. Waitlist Policy:

All members may add their names to a Class Waitlist should their class of choice be fully booked. You will be notified by email if a place comes available and will have 30 minutes to accept this place via the Member App before it is offered to the next person on the list. 

 

10. Drop In Policy:

Presently, website visitors may purchase a Drop-In Pass for Sweat Classes ONLY [10:30, 12:30, 13:05]. Details of illness, injury, and medication along with emergency contact info must be provided. All drop-in passes will be subject to the same Waiver of Liability and Terms of Use. 

11. Discount Policy

We at Barbelle Health have taken great care to ensure our pricing reflects a fair exchange for our high-quality Service. In our experience, discounts largely devalue a Service over time and create price wars amongst local small businesses which do the opposite of fostering a sustainable economy.   

In saying this, we do believe that Discounts have a certain role in our business to ensure inclusion and affordability for all. 

This section outlines our Discount Policy, Terms and Conditions. Discounts cannot be used in conjunction with any other offer unless the specific terms relating to the Promotional Discount Codes state that you can combine the specific discount code with other offers.   Our standard terms and conditions of sale apply in respect of any orders placed using Discount Codes and the Website Terms of Use for using our site also apply. We reserve the right to vary or discontinue the Discount Policy at any time. 

 

A. Student Discounts & Minimum Age for Joining

BarBelle Health presently offer a 15%  Student Discount to any person aged between 16 and 19.  To avail of this discount, please email us before sign-up.  

In most cases we will ask for written consent from a parent / guardian and request the parent / guardian to accompany you to your Game Plan appointment. The parent/guardian must either sign or witness and approve the student’s signature on our Waiver of Liability.  We will then apply a discount to the membership of your choice.Presently, you must be at least 16 years of age to join BarBelle Health.We reserve the right to ask for proof of age when any person requests a student discount. 

 

B. Household Discount

 A 10% discount is offered per person to members joining Barbelle Health and living in the same household. We reserve the right to ask for proof of address in these circumstances. 

C. Workshop & Events

Any person with an active membership can avail of a percentage discount to Barbelle Health workshops and events. Details of such discount codes will be emailed to members who register interest in any upcoming events. Discounts may not be passed on, duplicated, or otherwise shared with other members or non-members. One discount is permitted per order.  
 

D. Corporate Rates

Barbelle Health can offer a corporate rate to companies looking to register a minimum of 5 employees for our Service.  For more details, please email Us at hello@barbellehealth.ie. 
 

E. Other Discounts

Barbelle Health do not offer “mates rates” discounts nor do we offer any other type of discount unless expressed explicitly above. We believe this enhances transparency and equality amongst our members. As a small business we thank you for your understanding and support in our efforts to grow. 
 
 

12. TimeTable Changes:

Barbelle Health reserves the right to change our Timetable at any point in the calendar year. While we endeavour to provide a 30-day notice period to all Active Members, this might not always be possible. In any unforeseen circumstances, including but not limited to illness, staff unavailability, building refurbishments, natural disasters, COVID-19 and any other; we will amend class credits where possible and be clear in our communication to all members. Your experience is of the utmost importance to Us.

13. Filming & Photography:

Barbelle Health will, at times, record short video clips of member workouts for promotional material which may be shared online through our social channels and / or website. By accepting these Terms & Conditions, you are consenting to be included in our promotional material. Any member who wishes to abstain from such content, should email Us stating that their image is not to appear in our promotional material.Similarly, should an image appear on our platforms which you are not happy with, we will remove it. The aim of our content is always to highlight our Gym’s inclusive, friendly, empowering culture and atmosphere.

14. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

15. Governing Law

These Terms shall be governed and construed in accordance with the laws of Ireland without regard to its conflict of law provisions. 

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service. 

16. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. 

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
